Acceptance of the conditions of use

These Conditions of Use regulate the use of the bnc10 App / Web that BNC10 BARCELONA FINTECH S.L. makes available to Users

The Conditions of Use together with the Legal Notice, the Privacy Policy and the Cookies Policy constitute the terms and conditions that rule the access and use of the public part of the App / Web.

The access and use of the App / Web implies that the User accepts in full and is obliged to accomplish with these Terms and Conditions. bnc10 reserves the right to update, modify or eliminate these Terms and Conditions of the App / Web.

Conditions of use for the App/Web

The User undertakes to make good use of the App / Web, with good use being understood to be in accordance with current legislation, good faith and public order. Likewise, the User undertakes not to use the App / Web for fraudulent purposes, as well as not to carry out any misconduct that could damage the image, interests and rights of bnc10 or third parties. In the same way, the User undertakes not to perform any act in order to damage, disable or overload the App / Web, or prevent, in any way, the normal use and operation thereof.

The User will be responsible for the veracity and legality of the information provided in the forms issued by bnc10 for access to certain Content or Services offered by the App / Web. In any case, the User will immediately notify bnc10 of any event that allows the misuse of the information recorded in said forms, such as, but not only, theft, loss, or unauthorized access to identifiers and / or passwords, in order to proceed with their immediate cancellation.

The User is informed that, in the event of breach of the content or obligations arising from the Terms and Conditions or any other particular terms or conditions included in the App / Web, bnc10 reserves the right to limit, suspend or terminate your access to the App / Web, adopting any technical measure that is necessary for that purpose. Likewise, bnc10 reserves the possibility of exercising such measures in the event that reasonably suspects that the User is violating any of the terms contained in these Terms and Conditions or of any other particular terms or conditions included in the App / Web.

bnc10 reserves the right to update, modify or delete the information contained in the App / Web, including the contents and / or services that are integrated into it, and may even limit or not allow access to such information, at any time and without prior notice. Especially, bnc10 reserves the right to eliminate, limit or prevent access to the App / Web when technical difficulties arise due to events or circumstances beyond bnc10 that, in its opinion, reduce or annul the security levels or standards adopted for the appropriate App / Web operation. To this end, bnc10 reserves the right to, at all times, decide on the continuity of the services of the society of the information that it provides through the App / Web.

Intellectual and industrial property

BNC10 BARCELONA FINTECH S.L. by itself or as an assignee, is the owner of all intellectual and industrial property rights of the App / Web as well as the elements contained therein (by way of example and not exhaustive, images, sound, audio, video, software or texts , brands or logos, color combinations, structure, design, selection of materials used, computer softwares necessary for its operation, access and use, etc.). They will, therefore, be works protected as intellectual property by the Spanish legal system, being applicable both the Spanish and community regulations in this field, as well as international treaties related to the subject and signed by Spain.

Any type of exploitation is prohibited, including all types of reproduction, distribution, transfer to third parties, public communication and transformation, through any type of support and means, of the aforementioned works, creations and distinctive signs without prior and express authorization of their respective Headlines.   • • in the case of violation of third party rights, such as intellectual and industrial property, the data of the owner of the infringed right must be provided when he is a person other than the communicator. Likewise, it must provide the title that proves the ownership of the rights violated and, where appropriate, the representation to act on behalf of the owner when he is a person other than the communicator.

The receipt by bnc10 of the communication provided in this clause will not imply effective knowledge of the activities and / or contents indicated by the caller when this is not evident. In any case, bnc10 reserves the right to suspend or withdraw the contents that, although not being illegal, are contrary to the norms established in these Conditions of Use, weighing in each case the legal assets in conflict.

Responsibilities

bnc10 does not guarantee continued access, or the correct display, download or use of the elements and information contained in the pages of the bnc10 homepage, which may be impeded, hindered or interrupted by factors or circumstances beyond its control.

bnc10 is not responsible for the information and other content integrated into third-party websites or spaces from which you access through links, hyperlinks or links to the bnc10 homepage or any of its websites, nor for the information and contents of any website of third parties that appear under the appearance or distinctive signs of bnc10, unless expressly authorized by the latter.

bnc10 assumes no responsibility in relation to the information, content of all kinds, products and services offered through the bnc10 portal by third parties or entities.

bnc10 also assumes no responsibility for damages, losses, claims or expenses, produced by:

Interferences, interruptions, failures, omissions, telephone breakdowns, delays, blockages or disconnections in the operation of the electronic system, motivated by deficiencies, overloads and errors in telecommunications lines and networks, or for any other cause beyond the control of bnc10;

Illegal intrusion through the use of malicious programs of any kind and through any means of communication, such as computer viruses or any other; improper or inappropriate use of the bnc10 website; or security or navigation errors caused by a malfunction of the browser or by the use of outdated versions of it.

Applicable law

The content of this Legal Notice will be governed in accordance with Spanish law.

The parties submit the resolution of any dispute or claim related to the bnc10 App / Web to the Courts and Tribunals of the consumer’s domicile.
